Maryland lawmakers are debating whether to expand legal gambling to include online casino gaming and online bingo.
Two Senate measures are under consideration: SB 761*, which proposes placing a constitutional referendum on the November 2026 ballot to let voters decide whether to authorize internet gaming, and SB 885*, which would only take effect if the referendum passes and is designed to establish the regulatory framework for this expansion, including funding public education. If voters reject the referendum, no expansion occurs, and SB 885 does not advance.
SB 761’s role is to refer the question of online casino gaming to voters. SB 885, contingent on voter approval, would implement specific provisions for licensing, oversight, and consumer protections—including eligibility requirements for licenses—administered by the Maryland State Lottery and Gaming Control Commission. Supporters believe that this legal structure could modernize Maryland’s online gambling industry while addressing the existing offshore market.
Currently, residents seeking real-money online gambling often turn to offshore casinos, based outside of U.S. jurisdiction, that accept wagers from Marylanders. These sites operate without state oversight, diverting potential tax revenue that could otherwise support local priorities. Bringing online play under legal oversight would allow Maryland to retain economic benefits.
Navigating Regulatory, Economic, and Social Concerns
Supporters of the expansion emphasize potential revenue gains and state-regulated player sites. By regulating internet gaming, the state could generate significant new tax income while imposing local responsible-gaming safeguards. Advocates have highlighted that regulated online casinos in other states have contributed millions to education funding and promoted job growth in related sectors.
But some groups are cautious. Casino operators worry mobile play could reduce in-person revenues. Union representatives fear job losses if more people choose online platforms over visiting physical casinos.
Lawmakers have addressed this by adding support for workers and centering licensing on current casino operators and approved partners.
The Path Ahead: Hearings and a Voter Decision
The legislative calendar lists upcoming hearings and debates that will shape the fate of online gaming in Maryland. Lawmakers scheduled hearings on March 11 to review a package of bills related to online casinos, multi-state online poker, and sweepstakes enforcement measures. These discussions aim to refine the proposals and assess public and industry feedback before final votes in the General Assembly.
If both SB 761 and SB 885 pass through the legislative process, the expansion of online gambling—including regulated access to casino games online—would be put to a statewide vote in November 2026. A favorable voter response would usher in a new era of iGaming in Maryland, requiring the establishment of regulatory implementation and licensing protocols in the months following the election.
Until the issue is resolved, Marylanders continue using unregulated offshore platforms, underscoring the importance of legislative action to establish a safe, regulated online casino environment.
